In 2002, the U.S. Supreme Court outlawed the death penalty for people with severe mental retardation. As Supreme Court decisions go, this one seemed pretty much like a no-brainer.
Five years later, however, we're still trying to figure out who is severely mentally retarded and what the process for determining severe mental retardation is going to be.
