Is Antonin Scalia coming to Georgia?

We’ve all been led to believe that there are mechanisms in place to prevent miscarriages of justice, like an innocent man being executed.

We’re familiar with the “CSI Syndrome,” the fanciful theory that new DNA technology prevents such miscarriages from occurring. We know about the 200 people who have been freed from prison because of such technology – including 15 from death row. We’ve read the investigative reports from Texas and Missouri, which indicate that at least four innocent people have been executed. And when we hear the number 124, we know that’s the number of people released from death row after new evidence of innocence emerged.

However, despite these facts, figures and the tremendously popular hit television shows, we still have people like Supreme Court Justice Antonin Scalia who cling to the notion that an innocent person has never been executed in our country. It was Scalia himself who famously said last year that if an innocent person were executed, that person’s name would be “shouted from the rooftops.”

How could Scalia be so wrong? And has he now taken up residence in Georgia?

The truth is that recent polls reveal a large majority of people believe an innocent person has been executed. And soon – very soon – it could happen in Georgia.

Troy Anthony Davis is sitting on death row. His life is in the balance for a crime many believe he didn’t commit. Davis’ case is a classic example of “CSI Syndrome;” no physical evidence links him to the murder: no hair, no fibers, no blood, not even a murder weapon was found. The appellate courts, yet another mechanism designed to prevent wrongful convictions, are of no help, thanks to a federal law passed in 1996 that prevents federal courts from reviewing new claims of innocence.

Next Thursday the U.S. Supreme Court will consider Davis’ case one last time. After that, an execution date could be set next month.

The state of Georgia is basing its decision to put Troy Anthony Davis to death on eyewitness testimony — the only evidence used to convict him. Of the nine eyewitnesses that implicated Davis, all but three have recanted. In all incidences, these eyewitnesses have given disturbing reasons for implicating Davis in the first place, such as police intimidation and coercion. One witness was persuaded to sign a police statement implicating Troy Anthony Davis despite the fact that he could not read.

No DNA, no physical evidence, no murder weapon, and a lack of reliable eyewitness testimony have not been enough to lead Georgia back from the brink of making a colossal error. With Troy’s life in the balance, the Scalia mindset harshly moves forward. Most disturbingly, this execution is being carried out in our name.

Troy’s fate now lies in the hand of Georgia’s Board of Pardons and Paroles—which has the sole power to grant him clemency. Regardless of your personal feelings on capital punishment, we can all agree that the state of Georgia should do everything in its power to prevent the execution of an innocent man. We need it “shouted from the rooftops” that there are problems with this case and that Georgia must not execute a person when such pervasive doubt about guilt exists.

Such a sad story. My wishes and prayers go out to this man... We have to continue to fight this fight together to get all these men and woman off death row as we can not say in our hearts who is innocent and who is not being as though none of us were there. NO JURY should sentance ANYONE to death.. WHO are we to say someone should die for something that may or may not have done. Even if they did do it, how can someone think that punishment is death? I can not figure out the world today and what people are thinking. States like Texas... that is alot of people that are letting these men and woman die, for no reason but they are ignorant. I am disgusted and sad to call this country of ours my home with all that goes on in the prisons around the country. We WILL fight to help this man.. forever!

In this day and age there should be no death penalty, especially for those who are innocent!!! Troy is one of these innocent men that deserves his life back in the free world. Im sure justice will be done as Troy has many many supporters who will fight for him...forever, the evidence speaks for itself, killing inmates doesnt right the wrongs just causes more pain for more people all over the world, we are a strong group of people who will fight til the end,

I am totally appalled that with all the technology there is in the world today, innocent men are still incarcerated and even worse than that...there are men like Troy Anthony Davis on deathrow!!!! What is the world coming to??? I do hope the Justice system does the right thing and free Troy, 17 yrs he has lost of his life already, for a crime he didnt commit, his family have suffered also. I pray for justice to be done and truth to be told... we do not live in the dark ages anymore.

I truly hope Troy will be saved. And that that barbarian law will be abolished as soon as possible, I'm not American so I shouldnt feel concerned but honestly, as a citizen of the world and a philanthropist I really hope a better solution will be found, such a life emprisonment in the most extreme cases, since the goal is to protect society from an individual, not to take some blind, violent, criminal revenge. Not to mention all the innocents who have been assassinated legally.

God bless those who are trying to abolish the death penalty, and all of the inmates on deathrow - along with each member of their famillies. May His grace be sufficient in all things, and may you look to Him for comfort during this time. It is my prayer that the death penalty be abolished, and I ask that God impress upon those who make the decisions, the urgency in taking care of this, before any more innocent people perish.

This story truly saddens me. Not only is an innocent man likely to be executed, but the real murderer is still out there free to kill again. To execute Troy is not only an injustice to him and his loved ones, but also to the victims and their loved ones. I believe the death penalty is wrong and should be abolished, but for those that believe in it, what kind of justice is it to execute the wrong person? There are just to many holes in this story, to many things that do not make sense, and no physical evidence. How a jury could have possibly chosen to convict him is beyond me! My thinking is that it was a young, poor, black man accused of killing a cop and that is all they saw. They never fully looked at the evidence, or lack thereof. My thoughts and prayers are with Troy and his loved ones during this time.

I suggest Justice Scalia revisit the case for Joseph Nichols; a Texas inmate recently executed. More importantly I suggest that he question the inmates on DR that witnessed the events which led up to the execution. Afterwards, let him be the first to shout from the rooftop!!! I have a few stories of the innocent in prison and can cite a few examples of prosecutor misconduct and police abuse of the war on drugs which has become a weapon of mass destruction. Mike Nifong recently disbarred, the AG in the Genarlow Wilson case [which is a black man **SMH**], the murder of the Georgia woman by the police etc etc etc If we have a USAG that refuse to resign and will not be fired by the President, then I am not surprised at Justice Scalia's mentality which is complete DENIAL. Texas has killed the most inmates which included the innocent and I am ashamed to say I live in Texas.

My thoughts and prayers go out to the family and friends of Troy. I pray for his release with Godspeed!

Simply put, the death penalty can not be justified. In recent years hundreds of lives have been spared from state funded murders. How many people have been killed unustly? TOO MANY. Our justice system has been prove to be full of flaws and we continue to kill. One more person is one more too many that.

The death penalty is an abhorrent, archaic 'punishment' and no society should have it gazetted in legislation. No form of murder is justified! State sanctioned murder must be abolished. If this doesn't happen it will only be a matter of time before the government has to admit an innocent has been executed! Come on USA...wake up... stop preaching to other nations in regards to their human rights abuses and start looking at your own!

Interesting that a condemned man's innocence should be “shouted from the rooftops" at a time when a majority of Americans who still favor the death penalty might reconsider if there was enough evidence of an innocent person having been executed. Invoking the Declaration of Independence and its legal procedure for change to a new Government is what saves innocent People, this has been in motion at the White House since 1997 and is being done all across the United States. The old regime isn't interested in saving innocent People. And when they are no longer seated (which will be soon) and have to face all these innocent People and their families what will they do? Now People will know their names and their addresses, who is doing this - who keeps condemning the innocent to die or be imprisoned? It is already a new day in the United States.

Since 1997 some prisons are closed and the death penalty has been abolished in many states and the trend will continue.

Oh that is another case that has touched my heart. It is so hard to fathom in this day and age that GOVERNMENTS do such barbaric things, such as the death penalty *cough murder people cough* No matter what anyone does in this world, NO body has the right to take lives!
To the politicians and senators who keep voting for the death penalty to stay. Don't you think it is time to change with the times and come up with a better way to tackle the issue rather than just KILL people.

We are supposed to be innocent until PROVEN guilty beyond a resonable doubt. Unfortunatly that is not the way it works. Eye witness testimony alone should not be allowed to convict someone there should have to be solid irrefutable proof. Eyewitness testimony is notoriously unrealiable. Police intimidation is something else. ALL reports of it should be invesitgated by a outside party. My thoughts and prayers are with this case that real justice will be served. As for saying that no one that was not guilty was ever put to death I don't know what sand pile Mr. Scalia has his head buried in, but he needs to unbury it! No system that is run by humans is perfect.

It's another sad case of wrongful This situation isn't nearly as rare as the media and people in the justice system will try and make it out to be. THIS COULD HAPPEN TO ANYBODY! And for those who are wrongly convicted and awaiting death-row or serving time for crimes they did not commit, Keep hope alive and take comfort in the fact that people are out there every day trying to help. Even IF he was guilty, to execute him would be wrong. Other countries show how it is done properly, and that a lot of people can be rehabilitated and would never commit another crime. Everyone deserves that 2nd chance, because we can not judge on the circumstances anyone commits a crime under. I don't know if Troy is guilty or innocent, but I don't need to know that to say that his life should be speared. There are too many open questions and too many statements everyone should think about. And this is not the only case it is happening in. Even DNA results have found to be faulty. As long as a human can be bribed with something, the justice system will never be 100% sure.

Eye-witness testimony is simply not a reliable basis for a death penalty conviction. If all but 3 witnesses have recanted--citing in some instances police coercion--what makes the remaining three any more reliable? The system is broken; the death penalty should be abolished not only because human beings are bound to make mistakes, but also because it is WRONG. Scalia can ease his conscience with the delusion that no innocent person has been executed, but that is precisely what it is--a delusion. Troy should not be executed and I hope someone with the authority to stop this injustice will step in and do the right thing for once.

And how dare the legal system think that they can play god!! What about the familys of these people they havnt done anything wrong to deseve this. I dont think that troy should be sentenced to death without hard evedance proving he is guilty. My thoughts and prayers will be with Troy and his family. Eyewitness testimony is the most flimsy evidence that can be used. I cannot believe they would impose death based on eyewitness testimony alone. This is why the death penalty should be eradicated!It is never fair and it is inhumane. It just creates more victims.

The abolishment of the death penalty in the USA is long overdue. Too many innocent, mentaly challenged, and others are put to sleep like animals in a less humane enviornment. To kill legaly is no better to kill criminaly, actualy it's worse. Premeditaded.
We set a POOR example for our children. We teach them killing is wrong, yet men are executed on a steady basis. Wh is really making the $$$$$$$ in these death row cases. Is that what it is REALLY about? Because it does NOT deter crime.

It astounds me that the death penalty and lethal injection is not a subject that the people of the United States are not "All" familiar with! Just this weekend I spoke with a woman who had no idea that my state (Arizona) had just executed a man. I have spoken to many that have no knowledge of the death penalty or lethal injection issues. I have to assume this is because of the lack of true media coverage on a daily basis from an anti death penalty view.

The death penalty Is Legalised barbaric Murder. It horrifies me that there are people In authority of civilised nations that take part In these executions. Although they may claim that It Is a deterent I understand that It so effective for that purpose and that these brutalities may be brutilising and corrupting the minds of innocents also. I still have painful childhood memories of the scenes of barbaric hangings In the UK and the thought of the so-called humanitarian executions in the US Mortify me further since It Is apparent that these have been unhumanitarion and the victim Is hardly In a position to defend themselves or complain after they've been paralised by paralising drugs.The electic chair and gas chambers are of course places of torturous and painful death for the victim. There Is no real rational reason for a civilised nation's charge to act this way other than to indulge themself In murder of another person as there clearly are custodial alternatives to execution of prisoner and history has shown that completely innocent people have been wrongly executed!

When I heard about this case I figured I'd do some research before I believed Troy Anthony Davis was innocent. I also figured if noone was willing to help look into the case furthur it was because he is black with little or no money. And low and behold I was right.
I am not against the death penalty as many of the people writing on his behalf are. I am, however, against stupidity and pride.
Here it is, a man's life is at stake, and noone is willing to find out who was the one who truly committed the crime.
Yes, an officer was killed. And yes its a tragedy. Yet, the courts are being bull-headed to the fact they are possibly condemning the wrong person.
It seems they are choosing to be blind and ignorant to Troy Anthony Davis' plight. They figure if they stand their ground this will all go away and they can sleep better at night. They probably feel that they did the right thing. We all know the judges, and attorneys and police officers only look out for each other. So we should not be shocked that they are not looking out for Troy Anthony Davis.

I think it is wrong to execute it is inhumane and barbaric. Many people on Death row are innocent. Eye witnesses can be wrong, people can be framed while the real criminal is free. America is 1 of the few countries that still has the death Penalty. For those who are innocent set them free, For those who are guilty let them live with their guilt for the rest of their lives. Historically speaking the death penalty has never deterred crime. It is just cold blooded murder in the name of the law. Everyone needs a fair trial with due process of the evidence, and if they are murdered by the state without it, and new evidence comes to light what do you say "So sorry mrs. Johnson it turns out John Doe killed that person we caught him but your son is dead for nothing." Kevin

Whether Troy Anthony Davis is innocent or not - and innocent he most probably is - the barbarism of capital punishment undermines the very core of our humanity. Yet another tragic indictment of the moral and political bankruptcy of all nations who persist in the state-sanctioned murder of their citizens in the name of so-called 'justice'. What kind of justice is this? The death penalty aside, reasonable doubt is all that is required for a verdict of innocence. Davis' case presents far, far more than reasonable doubt.

This story is extremely upsetting. To start off with, the death penalty should not be legal in the US not only because new evidence demonstrates its inherent flaws but also because it sends out a perverse and controversial message, namely that it is just for a small group of people to have the power to determine the fate of another human life. The particular circumstances of this case, which represent the core issue at hand, demonstrate how incredibly defective, discriminatory and inequitable the justice system is. Death should never be considered a legitimate punishment and Troy, an innocent man, should be granted the justice he deserves.

How sad that civilisation is still at this old testament stage of an eye for an eye. The State has a duty to protect all citizens and should set an example, not follow the most base human action. Innocent until proven guilty is an important principle of any civilised nation. Once less murder on death row- one more victory for humanity and compassion. Let us pray for justice.

It's very frustrating and tragic that the courts care more about their damn rules and timelines than the truth, innocence, justice and saving lives. The death penalty is unfair and wrong and needs to be abolished. There are too many problems with our legal system. District Attorneys have all the money and police and power behind him, and the most of the defendants are poor minorities who can't afford a good attorney so they either get stuck w/ an overworked public defender who doesn't have the time or the resources behind him like the DA, or else a court-appointed attorney who doesn't give a damn bc he's not getting paid enough to devote as much time and effort as he would for his rich clients. And judges half the time don't care enough to make sure the attorney is doing his job to the best of his ability. 124 people on death row have been exonerated. How many innocent people have we actually executed? Death penalty is not a deterrent. Do you honestly believe that when someone commits a crime that they stop and think about the punishment? No, they are arrogant enough usually to believe that they won't get caught. And many of the murders that take place are committed in the heat of the moment or a crime of passion. Death penalty is not about justice but vengeance. What vengeance is there to gain by executing an innocent man like Troy?

I find it to be absolutely horrifying that in this day and age when we have all of the information concerning DNA that we need, that anyone could be sentenced to death without any hard, physical proof of their guilt. The fact that Troy Davis' life has been destroyed merely by heresay is a CRIME! This innocent man is locked away, having been stripped of his rights, just waiting to be murdered by the state of Georgia... and for WHAT??? I am embarrassed to be an American! How can we kill our own people, let alone people who HAVEN'T been proven guilty, and go on living our lives as if it's ok?? And even for the people who have been proven guilty- we have it shoved down our throats from a very early age that two wrongs don't make a right. What ever happened to that? And if someone really is guilty, what would be worse: spending the rest of your natural born life in prison with nothing to do except think of what you did, why you are there and all of the people you hurt, not being able to see your family but knowing the pain YOUR actions have caused them OR suffering in prison for a few years and being murdered by the very government that imprisoned you for the same crime, only to no longer have to face where your actions have put you. It just doesn't make any sense. One thing is for sure, this man should NOT be imprisoned because NO ONE CAN PROVE THAT HE HAS DONE ANYTHING WRONG!!! I'm sorry....but how does a public poll prove the innocence of this man? He was convicted, and if you go into a prison and hold a poll, 100% of the inmates are innocent...right? An innocent man should not die. granted, but the court found him guilty.

AS JOSH SAYS A PUBLIC POLL DOESNT PROVE SOMEONES INNOCENT BUT THE LACK OF EVIDENCE IN TROYS CASE CERTAINLY DOESNT MAKE HIM GUILTY!!! AS MANY PEOPLE HAVE ALREADY STATED WE TEACH OUR CHILDREN NOT TO FIGHT AND THAT 2 WRONGS DONT MAKE A RIGHT, HOW CAN WE AS RESPONSIBLE ADULTS JUSTIFY THE DEATH PENALTY??? I AM DISGUSTED THAT AN INNOCENT MAN MAY BE "MURDERED" BY THE STATE OF GEORGIA BECAUSE THEY DONT WANT TO HEAR NEW EVIDENCE IE WITNESS TESTIOMONIES RECANTED 6 OUT OF THE 9 TO BE EXACT. HOW WOULD YOU EXPLAIN TO A MINOR THAT ITS OK TO EXECUTE PEOPLE EVEN IF THE STATE ISNT 100% SURE THEY GOT THE RIGHT PERSON??? HOW DO THEY SLEEP AT NIGHT?

How many more innocents are sitting on death Row waiting for a wrong execution? Is a shame that This country still killing people, they are worse than the killers, They kill for the amount of $150.00 they are serial killers, look the example in Texas... is killing 5 at the time every month those are serial killers, but you will be judge by God in the day of the Judgment!! Stop the execution!! Say No to the Death Penalty! Troy stay strong you have hundreds or more praying for you.

It's a shame to see that Georgia is willing to execute innocent people. Everyone who claims Troy Anthony Davis is guilty must be blind. Is this justice to sentence people to death despite of reasonable doubts? No. It's a travesty of Justice. I wonder how many innocent people have to be executed until the last one comprehends, that the death penalty system is totally broken and full of corruption. I hope the people will wake up now and help to save Mr. Davis life. Sign his petition, send a fax to the parole board! Who wants to live in a country, where justice is an illusion? Don't talk, DO something! Everyone who's willing CAN take action!!!

nobody has the right to place another person on death row?? how about the lives of innocent people who were killed by the murderers on death row? what about their rights to live? capitol punishment is the just way to deal with people who unjustly take peoples lives. why dont you people understand; that if you start kiling all the murderers...there will soon be no more murdering!! after all..capitol punishment is proven to be an effecitve deterrant. I vote to empty death row. kill them all.

The killings need to stop. My husband was an innocent man killed last year by the state of Texas. The United states needs to wake up and see what there doing is wrong. I'm very proud to be canadian the true land of the free

I wrote the Governor of Georgia, I suggest you all write him, its easy, just ask to give the guy a break, who is it hurting? Other than Troy... Anyway It is better to let 10 guilty go free than to convict 1 innocent...
